WILLS AND TRUSTS NOTARIZATION

A number of documents may need to be notarized to be valid when it comes to protecting your personal assets. Here are a few examples: A last Will and Testament, an Advance Directive, a Trust, filing custody agreements, and Power of Attorney (POAs).

A NOTARY ACKNOWLEDGMENT

An affidavit is a written statement that can be used as evidence in court. For it to be admissible, it must be notarized by a notary public. The affiant (the person signing the affidavit) will appear before the Notary, who will verify their identity. The affiant will declare to the Notary that they have willingly signed the affidavit. A notary acknowledgment is signed and stamped by the Notary and will be attached to the affidavit.

ADOPTION DOCUMENT NOTARIZATION

Adoption is the legal process in which children who will not be raised by their birth parents become full and permanent legal members of another family. As adoption is a legal process, a notarized signature confirms for the court that the person whose signature appears on the notarization document is the person who signed the official adoption papers. The Notary will verify the identities of all the signers, will witness the signatures on the papers, and confirm that all signers did so willingly and not under duress. Notarization confirms the authenticity of the signatures.

AFFIDAVIT AND OATH NOTARIZATION

Suppose a certificate mentions that the signer has ‘sworn’ to or ‘affirmed‘ the statements in a document. In that case, an oath or affirmation must be administered by a notary. In addition, an oath or affirmation is required when a credible witness comes to identify a document signer who is unknown to you and who does not or is unable to present the required identification.

DEED NOTARIZATION

Anytime a piece of real estate changes hands a deed is required. A deed is a legal document used to transfer ownership of property from one party to another. In all cases, a deed must be notarized.

CONTRACT NOTARIZATION

In general, there is no obligation for a contract to be notarized for it to be enforceable. However, if one party of the agreement wants to go to court, notarization helps. This is because notaries identify the person signing the document and confirm the person’s signature. A notarized document proves that the person who objects to the agreement was the person who signed it. A notarized document is not necessary, but it is helpful if your contract is ever taken to court.

DIVORCE DOCUMENT NOTARIZATION

A lot of paperwork is associated with a divorce, and some documents will need to be notarized. If a form needs to be notarized, it will typically have the notary acknowledgment wording, with a space for the notary signature and a space for the stamp or seal. When a form needs to be notarized, it is important not to sign it beforehand. The Notary needs to witness the signature to notarize it. A divorce attorney will clarify which forms need to be notarized.

NOTARY LEGALIZATION SERVICES

The key difference between notarization and legalization is who does the verification. A notary will verify your signature on a document, but legalization verifies the Notary’s signature, which is usually performed by the secretary of state’s office or the state’s Notary commissioning agency. Legalization can mean getting an apostille certificate, getting consular legalization, or both.
